This page summarizes Section 3.4 (Refunds) and Article 11 (Term and Termination) of the HRMXGO Terms of Service. The Terms of Service, together with your Order, are the binding agreement between HRMXGO Inc. and your company. If anything on this page differs from the Terms of Service, the Terms of Service apply.
Free trial. HRMXGO offers a 14-day free trial. We do not ask for a payment method and we never charge you at the end of a trial. Your trial becomes a paid subscription only when your company signs an Order. If you sign an Order on or before the last day of your trial, you receive 10% off your first year, and your paid term starts the day after the trial ends, with no interruption. If you do not sign an Order, your access ends when the trial ends and you have 15 days to export your data before we delete it.
Annual subscriptions. HRMXGO subscriptions are sold on annual terms under an Order (signed, or accepted online by your Administrator). Subscription fees are payable in advance as set out in your Order and are non-refundable except in the situations listed below.
Not renewing. Your Order renews automatically for a further 12 months unless either party gives written notice of non-renewal at least 30 days before the renewal date. Send your notice to [email protected] and state that it is a notice of non-renewal under Section 11.1(b) of the Terms of Service (Section 13.3 of the Terms of Service requires this). We will email your Administrator a renewal reminder at least 45 days before each renewal date. When you give timely notice, you keep full access to HRMXGO until the last day of your current term. No refund is due for the remainder of that term.
Ending your subscription early. You may terminate your Order early on 30 days' written notice, but the fees for the rest of your current term remain payable and are not refunded.
When we do refund. We refund the unused portion of prepaid fees, calculated daily from the date of termination and paid within 30 days, if: (1) you terminate because HRMXGO materially breached the Terms of Service and did not fix the breach within the cure period; (2) HRMXGO terminates your Order under the intellectual-property remedies in the Terms of Service; (3) an event beyond our control stops us from providing HRMXGO for more than 30 consecutive days and either party terminates for that reason; or (4) we add a new subprocessor, you object on data-protection grounds under our Data Processing Agreement, we cannot resolve your objection within 30 days, and you terminate the affected Order for that reason. Refunds are paid to the payment method you used or by wire transfer, and are stated exclusive of sales and similar taxes, which we refund or credit to the extent we can recover them from the tax authority, as set out in Section 3.4(c) of the Terms of Service.
What we do not refund. Unused users or features, periods after you give notice of non-renewal, changes to or loss of optional third-party integrations or beta features, or subscriptions suspended or terminated because of a breach of the Terms of Service by your company.
